Terms of use

The rules for using this website and the MaxWealth suite. Clients on a subscription also have a signed agreement, which takes priority where the two differ.

01About these terms

These terms govern your use of maxwealth.money and of the MaxWealth suite (MaxWealth, CommissionIQ, SIP Doctor and Studio), which are owned and operated by Mindstack Technologies Pvt. Ltd. ("Mindstack", "we", "us"). By using the website or the platform you accept them.

Clients who subscribe to the platform also sign an order form or subscription agreement. Where that agreement and these terms differ, the signed agreement applies.

02What Mindstack does

Mindstack is a software company and is not registered with SEBI or AMFI as a mutual fund distributor, investment adviser, research analyst or stock broker. Investor money and units never pass through us, and we do not recommend any scheme.

Content on this website, including product walkthroughs, sample figures and articles, is for information about our software. It is not investment, tax or legal advice.

03Responsibilities of platform clients

Firms that use the platform to serve investors remain responsible for their own business, including:

  • holding and renewing the registrations their work needs, such as an ARN and EUIN, or SEBI registration as an investment adviser
  • meeting SEBI, AMFI, exchange and KYC requirements for every investor they onboard and every transaction they place
  • obtaining the consents and giving the notices the Digital Personal Data Protection Act, 2023 requires before entering investor data
  • checking the accuracy of the data they and their investors enter
  • any advice, recommendation or communication they send to their investors through the platform

04Accounts and access

Keep your login details and OTPs to yourself. Each client's administrators decide who in their team and network gets access and at what level, and they are responsible for activity under the accounts they create.

Tell us straight away at enquiries@mindstack.in if you suspect an account has been misused.

05Acceptable use

You agree not to:

  • use the website or platform for anything unlawful, fraudulent or misleading to investors
  • enter personal data you have no right to process
  • try to reach data belonging to another client, or to probe, scan or bypass our security
  • copy, resell, reverse engineer or build a competing product from the software
  • overload the service with automated requests beyond normal use

We may suspend access that breaks these rules, and will tell the client concerned why.

06Exchanges, registrars and other third parties

The platform connects to services we do not control, including BSE StAR MF, KYC registration agencies, registrars such as CAMS and KFintech, fund houses, payment and mandate systems, and NAV and scheme data sources.

Transactions are subject to the rules, cut-off times and processing of those parties. We pass instructions on accurately and promptly, and we are not responsible for delays, rejections, outages or errors on their side, or for the accuracy of data they supply.

07Fees

Fees, billing cycles and payment terms are set out in each client's quote or order form. Prices exclude GST and other applicable taxes. If an invoice stays unpaid past the agreed period, we may suspend access after giving written notice.

08Your data

Clients own the data they and their investors put into the platform. We process it only to provide the service, as our privacy policy describes, and on the client's instructions.

When an agreement ends, the client can export its data within the period the agreement sets, after which we delete it unless the law requires us to keep it.

09Intellectual property

The software, website, product names, designs and documentation belong to Mindstack. A subscription gives the client a limited, non-transferable right to use the platform for its own business during the agreement.

Clients who run the platform under their own brand keep all rights in their names, logos and content, and grant us permission to display them inside their workspace.

10Availability and changes

We work to keep the platform available and schedule maintenance outside market hours wherever we can. Uptime and support commitments, where agreed, are in the client's agreement.

The product improves over time, so features may change. If we plan to remove something a client relies on, we will give reasonable notice.

11Disclaimers

Mutual fund investments are subject to market risks. Read all scheme related documents carefully.

Projections, goal plans, returns and illustrations produced by the software depend on the assumptions and data entered and on past performance, which does not guarantee future returns. Apart from what a signed agreement promises, the website and platform are provided as they are.

12Limitation of liability

To the extent the law allows, Mindstack is not liable for indirect or consequential loss, lost profits, lost business or investment losses arising from use of the website or platform.

Our total liability to a client for any claim is limited to the fees that client paid us in the 12 months before the event that caused it. These limits do not apply where the law forbids limiting liability, such as for fraud.

13Indemnity

A client will compensate Mindstack for third-party claims, penalties and costs arising from that client's breach of these terms, breach of law, or advice and communications it gave its investors.

14Suspension and termination

Either side may end a subscription as the client's agreement allows. We may suspend or end access immediately where there is a serious breach of these terms, a security risk, or a legal or regulatory requirement.

Sections on data, intellectual property, disclaimers, liability, indemnity and governing law continue after termination.

15Governing law and disputes

These terms are governed by the laws of India. The courts at Mangalore, Karnataka have exclusive jurisdiction over any dispute arising from them.

16Changes and contact

When these terms change, the date at the top of the page changes too, and clients get advance notice of material changes. Continuing to use the website or platform after that means accepting the updated terms.
